In the matter of Petition under Section 86 (1) (f) of the Electricity Act, 2003 read with Agreement dated 14.12.2009 and undertaking dated 23.08.2011 seeking adjudication upon the dispute between the parties in terms of claim of POC of Rs. 6,00,94,050 for time barred period i.e., January 2012 to June 2016 which is barred by Article 55 read with Section 3 and 18 of Limitation Act, 1963 and to declare such recovery of POC for the above-mentioned disputed period as against contractual terms and provisions of law.
