Under section 86 (1) (a), (b), (e) and (f) of the Electricity Act, 2003 for adjudication of the dispute between the Licensee and Generating Company and for the decision that the petitioner is entitled for the Tariff of Rs. 3.37 /- per Unit without 15 % deduction for surplus energy sale after captive use in the Wheeling Agreement with the respondent (UGVCL) as the WTG was commissioned during the control period of GERC Order No.2 of 2006 dated 11/8/2006 read with the original Wind Policy 2007 dated 13/6/2007 and for issuing further direction to UGVCL to revise the amended Agreement dated 16/7/2011 accordingly and for issuing further direction to UGVCL not to apply rate of 85% of Rs.3.37 per Unit and also for further direction to UGVCL for refund of the amount of 15 % deducted up-till now and also for further direction to UGVCL to give set-off of wheeled energy generation for the month of March 2011 which is not given though the WTG was purchased by the petitioner in the month of March 2011 and the Wheeling Agreement was signed on 31/3/2011 by the petitioner and UGVCL.
