In the Petition under section 42 (2), section 86 (1) read with section 94 (1) (g) of the Electricity Act, 2003 and Regulation 3 (p) of the Gujarat Electricity Regulatory Commission (Terms and Conditions of Intra-State Open Access) Regulations, 2011 for granting NOC for Open Access and denial of NOC for Open Access is absolutely illegal, discriminatory, arbitrary and in violation of GERC (Terms and Conditions of Intra-State Open Access) Regulations, 2011 and strict interpretation of regulations incorporated in GERC (Terms and Conditions of Intra-State Open Access) Regulations, 2011 Notification No. 3 of 2011 in context with Open Access.
