In the matter of petition of adjudication of dispute under section 86(1) (f) of the Electricity Act, 2003 read with Article 8 of the Power Purchase Agreement dated 07.08.2008 executed between the petitioner and GUVNL, regarding wrongful levy of liquidated damage/ penalty amount of Rs. 44 Lakhs due to non- availability of the targeted generation during the FY 2012-2013 was a Force Majeure event as per the provisions of the PPA.
