Petition under Section 86 (1) (f) of the Electricity Act, 2003 read with Articles 8 and 11 of the Power Purchase Agreement dated 10.05.2023 seeking, inter alia, a declaration that the Petitioner’s non-commissioning of the Project was occasioned by Force Majeure events beyond its control, and that the Respondent is consequently not entitled to retain liquidated damages of INR 10 Crores paid under protest, invoke/ retain the Performance Bank Guarantee amounting to INR 10 Crores, or levy any other penalty / compensation.
