In the matter petition under Section 86 (1) (f) of the Electricity Act, 2003 read with Agreement dated
14.12.2009 and undertaking dated 23.08.2011 for seeking adjudication upon the dispute between the
parties in terms of claim of Parallel Operation Charges Bill amount Rs. 6,00,94,050 for time barred
period i.e. January 2012 to June 2016 (4 years 6 months) which is barred by Article-55 read with Section
3 and Section 18 of the Limitation Act, 1963 and to declare such recovery of POC for the above
mentioned disputed period as against the contractual terms and contrary to the Provision of law.
